You understand and agree that checking the box "I Agree" to accept these terms and conditions ("Agreement") is legally the same as manually signing this Agreement.

Membership and Security

PokerCommunity requires a registration process so that you may choose a member name and a password, so that we may permit you to use this service. By registering, you certify that you are at least eighteen years old, that the email address you provide in the registration is accurate and belongs to you and that PokerCommunity.org and its partners are not prohibited by applicable law to send you gambling related advertisments. The membership is personal and cannot be assigned.

You further agree that you will be fully and solely responsible for all activities that arise from the use of your user name and password. You will immediately notify us by e-mail of any loss, theft or unauthorized use of your user name and/or password.

THERE IS NO WARRANTY FOR SOFTWARE DOWNLOADED FROM THE WEBSITE, TO THE EXTENT PERMITTED BY APPLICABLE LAW. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS WITH YOU. SHOULD THE PROGRAM PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, YOU AGREE THAT IN NO EVENT SHALL POKERCOMMUNITY, ITS AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS OR LICENSORS, OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SERVICES, TECHNOLOGY OR CONTENT AVAILABLE ON THE SERVICES, BE LIABLE TO YOU IN ANY MANNER WHATSOEVER.

YOUR SOLE AND EXCLUSIVE REMEDY WITH RESPECT TO THE USE OF ANY SERVICES PROVIDED BY POKERCOMMUNITY SHALL BE CANCELLATION OF YOUR MEMBERSHIP TO THE SERVICES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; IN THOSE JURISDICTIONS OUR LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

Indemnification

The User agrees to indemnify, defend and hold harmless PokerCommunity, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement or any activity related to User's account (including negligent or wrongful conduct) by the User or any other person using the Service.

Entire Agreement

This Agreement constitutes the entire and whole Agreement between User and PokerCommunity and is intended as a complete and exclusive statement of the terms of the Agreement and shall supersede all other communications between the parties. This Agreement may be amended only upon execution of a subsequent agreement or upon User's failure to object within 10 days to modifications posted on PokerCommunity’s website.
